hack and spam attacks

1.) some one is using my email address as the from address and sending spam mails.

but not using my mail server.

since the from address is mine, i get complans asking to remove from the mailing list.

what to do.

2.) other problem some one sending lot of requests to the server and after some time IPs stop pinging.

when i restar the server manually it's ok and it goes down again in 30 mins.

what can i do hack and spam attacks
