What happen with up2date? Kernel updating related.

RPM package conflict error.  The message was:
Test install failed because of package conflicts:
package kernel-2.4.21-4.0.1.EL is already installed
I get above error message when trying to up2date -uv...

I did uname -a and see that kernel-2.4.21-4.0.1.EL is being in use... but why up2date still trying to install it?
