DOS attack - Can you Sue?

Well I have spent the last few hours reading the numerous posts about DDOS attacks and I apreciate any replys. I have information about my attacker. His IP, address and phone number. Infact this guy thinks he is so 'above the rest' he even contacts me on msn to give me ss's and information on what hes doing.

I know from others he is a script kiddy with a rather powerful script (as shown by belows ss). He is using a script and is intent on bringing my site down. So much infact I was kicked off my shared hosting as he was causing so much downtime for other users. Below is what someone who knows some more had to say:

When you get a new host, make sure you get shell access. Then you can just ban Lucas bot's ip addresses and your site will magicly jump back on the net. His 20-30 mIRC udp bots don't have even close to enough bandwidth to knock a server off. So instead he makes them all connect sockets to port 80. Thos sockets then sit there doing nothing untill the httpd times them out. Now when you have this connecting a socket at around 1/25ms you can effectly knock a site off the net. The httpd's connections max out and it can't accept any new incoming connections.
I am currently going to go dedicated and emailing hosts to see if they can provide protection as it isnt really the space or bandwidth that i need, its more the protection. So this is a multi purpose post. Firstly can we do anything about these people? Even when I know all of there details? Secondly would changing the port help? And finally any links to sites who have specialist equipment would help.
